TERMS & CONDITIONS

By using this site and placing orders herein, you are agreeing to the following terms and conditions and that you are over the age at which it is illegal for us to sell them to you.

1. Ordering and Availability

1.1 All items offered on our website are subject to availability and price change. We endeavour to advise on our website of any items that are currently out of stock wherever possible. If an item ordered is out of stock we will endeavour to notify you within seven working days of your order being placed. We will advise you of the likely time scale of any delay and/or price change, but you are of course free to cancel your order if we cannot fulfill within our allocated timeframe. Please Note: The Outdoorsman is a specialist supplier of outdoor products with a huge selection on offer that is not generally available on the high street, and in some cases will not be found in ANY high street store.  Some items are made to order, others are in high demand and this may affect the timescale in which we can deliver your order to you.  We ask that you bear this in mind when ordering your goods to avoid disappointment at a later stage.

1.2 Orders for any of our products can be placed via our Secure Online Server or by post with appropriate cheque or postal order payment please contact us if you wish to pay by cheque.

1.3 All orders placed will be treated as an offer to purchase that must be accompanied by a deposit of the full amount of your offer. Any automated reply that you receive shall not be deemed to be our acceptance of your offer to purchase. Acceptance of your offer to purchase shall only be deemed to be complete when we have sent a confirmation email of the despatch of the goods to the email address that you have provided (whether or not you receive that email), or by the goods having been despatched. We reserve the right to refuse or reject any offer to purchase at any time - if an offer is refused, we will refund your deposit in full.

1.4 We aim to process and despatch all orders as quickly as possible (usually within 10 working days).  We aim to keep every item in stock, though sometimes due to heavy demand we may be waiting for a stock delivery on some items.  We are also continually increasing our product range and this includes many specialist non-stock items which may take longer to deliver.  If your order is delayed and will take longer than 10 working days you will be advised so you have the opportunity to cancel. Cancellations due to slow despatch will be accepted if we have taken more than 10 working days to despatch your order. You will be advised by email when your order has been despatched where possible.

1.5 All orders are checked by us for the security of both you and us. We (or our payment provider) may request proof of address and/or proof of identification from you before your order can be processed. If this is the case we will contact you giving you full details of what is required.

1.6 All internet orders must be accompanied by active credit or debit card information. This information is handled and authorised by our third party payment provider and we cannot be held responsible for any misuse of your details originating at the payment provider. You should satisfy yourself to the payment provider's Terms and Conditions before placing your order.

1.7 We sell a wide range of products, some of which can be lethal if misused.  When agreeing to these terms and conditions, you are also confirming that you are aware of relevant laws and safe working practices relating to the products you are buying.  In terms of articles pyrotechnic, it is illegal for us to sell them to under 18's.  In terms of knives, it is illegal for us to sell them to you if you are under 18.  In terms of air rifles and pistols, it is illegal for us to sell them to you if you are under the age of 17.  Some of these products require specialist training for safe use.  By buying these products from our website, and agreeing to these terms and conditions, you are also confirming (in relation to pyrotchnics, knives and firearms) that you are over the legal age at which you can purchase them, that we can legally sell them to you and that you are aware of the safe practices for their use and also that you are able to get or have training in their use.  Fluffy pillows, though legally available, can be deadly if used inappropriately.

2. Payment and Ownership of Goods

2.1 We accept payment by all cards accepted by our payment provider. Your card will be debited upon placing the order. Should you return your goods for a refund your card will be refunded in accordance with the terms and timescale of the payment provider. In these Terms and Conditions of Business:- "Goods" means goods or products offered for sale by us. Your payment is accepted as a deposit under your offer of purchase and is therefore not to be considered a sale until your offer has been formally accepted by email on despatch of your order, or your goods have been despatched to you.

2.2 "Promotional Product" means an item or product offered free of charge with goods that have been supplied and paid for, or discounted to free.

2.3 Goods and promotional products supplied by us remain our property until the offer to purchase has been accepted and the deposit converted to a payment for such goods. If payment is declined by your cardholder, or your cheque is not honoured by your bank, whether before or after despatch of the goods to you, we will treat the order as cancelled.

If the goods and promotional products have been despatched we may:-
a) Require you to return the goods and the promotional products to us in good condition within 7 days; or
b) Require you to pay in full by satisfactory alternative means within 7 days.

3. Website Accuracy

3.1. Our Website designers work extremely hard to ensure our website is as accurate as possible and in order to achieve this our website is updated regularly.

3.2. We cannot guarantee the accuracy of information supplied, especially such things as product specifications, prices, special offers and promotions which may change without prior notice, before or after you have placed your offer of purchase with us.

3.3. Products, prices, offers, tariffs and promotions are valid only for the period they are displayed on our website (unless otherwise stated) - all of which are subject to availability and change without notice. If any of these should change to your detriment or become unavailable in the period after you have placed an offer of purchase with us we will contact you before proceeding with it.

3.4  Whilst we endeavour to be as accurate as possible with the information on our site, some inaccuracies may be present.  If inaccuracies are noted during ordering, we will inform you immediately, correct the detail and give you an opportunity to change or cancel your order.

3.5. Pictures of products are as a representation only and should be used only as a guide. Specifications and/or colours of products may change without prior notice.

4. Product Warranty

4.1. All products come with a manufacturer's warranty as detailed by the manufacturer on individual products. This warranty does not affect your statutory rights which cannot be excluded or restricted at law.

5. Delivery

5.1. Packages are delivered by various methods, whether by Royal Mail, Goods Carrier or Manufacturer Delivery, unless they are FAC firearms in which case they are to be collected at our location or your nearest licenced dealership.. The service type used will depend upon the value and size of the product/s purchased. Most delivery methods will require a signature upon delivery.  We can offer delivery schedules to suit your needs, but this may incur an additional charge.

5.2. Deliveries in transit are considered to be pending until the allocated time has passed to the item being marked lost by the delivery company. Refunds based on lost items will only be considerd once the delivery company has confirmed loss.

5.3.Weekend deliveries are not always available and if they are, they may incur an additional charge.

5.4. The Outoorsman cannot be held responsible for any delays caused by Acts of God, industrial action, vehicle breakdown, service providers, credit searches, stock availability and delivery companies. These events are outside of our control and we cannot accept any liability.

5.6. Parcels sent to remote parts of the United Kingdom, such as Northern Scotland and parts of Northern Ireland, the Channel Islands and the Isle of Man etc may take longer to deliver and may also incur an additional charge.

5.7. We do not deliver any orders outside of the United Kingdom unless by prior mutually agreed arrangements. To protect genuine card holders we do not accept card payments for deliveries to addresses other than the card holders registered address. The option for genuine overseas customers wishing to purchase goods by bank transfer of funds is available. Please contact sales@outdoorsman.co.uk for details.

6. Privacy of Information

6.1. We will not disclose ANY of your personal details to third parties unless such third parties are required for:  Delivery of your order, involved in warrantee issues, returns, fraud checking, debt collection or criminal investigations.

6.2 We will not at any time pass on your personal details for marketing purposes.

7. Pricing

7.1. The Outdoorsman is VAT registered and as such, there is VAT charged on our products - the listed prices are all inclusive of VAT in order to show an accurate and real reflection of our charges. The VAT charge is a government tax and therefore is shown in addition to our price at the end of the purchase process.  All Errors and Omissions are excepted. Prices are subject to change at any time.

8. Returning Products

If for any reason you wish to return a product or receive a replacement product please contact us. It is important that you contact us as soon as you become aware of any problem or wish to return an item.  For goods that are defective on arrival, we will offer a full refund or replacement of the item only as long as we have been notified of such defects within seven days of delivery of the goods.

Our Returns Policy forms part of our Terms and Conditions and applies to all goods and services supplied by The Outdoorsman.

It is essential that you read and fully understand our Returns Policy and familiarise yourself with our returns time limits and the charges that will be incurred should goods be sent back in a less than pristine condition and/or with items missing.

Cancellation of Orders For Other Types of Goods

You may cancel your order within 7 days of receiving the goods.

All goods including all packaging and any additional items such as free gifts, accessories and promotional vouchers must be returned to us in an unused and re-saleable condition.

Clothing must be unworn, and items must show no signs of use.

You must take reasonable care of all goods whilst in their possession. Goods received back in an unsuitable condition will unfortunately not qualify for a refund.

Manufacturer's Warranty

All goods supplied are covered by the standard manufacturer's warranty. Contact details for the manufacturer's technical helpline and customer services can normally be found on the product tags or can be obtained from us.

Returning Goods

In the unlikely event that goods do need to be returned to us you must obtain returns instructions by contacting sales@outdoorsman.co.uk. We will advise if the goods can be returned and where to send them to.

Return carriage costs are your responsibility unless the goods are defective on arrival at your address. We very strongly advise customers to return all goods over £28.00 in value to us using a tracked and insured postal service such as Royal Mail Special Delivery Service.

We are unable to process any returns, refunds or cancellation of contracts until the goods have been received and checked at our offices.

Royal Mail Recorded Delivery should be used only for returning accessories and goods below the value of £28.00 only. Special Delivery should be used for all items worth over £28.00. Compensation to the value of only £28.00 can be claimed from Royal Mail if items are posted using Recorded Delivery.

All goods should be packaged in a secure parcel to avoid damage in transit ensuring the contents are not on show.

Goods should be in their original unused condition, complete with all original items as below (as applicable):-

- Swing tags
- Outer packaging
- Bags and cases
- Instruction sheets/manuals
- Any other accessories included with the original item
- Any free gifts, incentives or vouchers included with the offer

A charge will be made for any goods that are returned back in an un-saleable or incomplete condition up to the full sale value of the item.

9. Refunds

Refunds will be processed within 7 days (normally within 2 working days) of us receiving the returned goods. Refunds will normally be credited to the payment card details provided at the time of ordering the goods from us - e.g. refunded to your credit or debit card. Alternatively, we may send you a cheque or postal order for the refund or offer items of similar value if you accept.

A charge (as above) will be made for any goods that are returned back in an un-saleable or incomplete condition. This will be deducted from your refund if applicable or charged against your debit or credit card details as provided at the time of ordering.

Refunds are processed through our payment provider and the time it takes for transfer of funds is subject to their terms and conditions.

10. Replacements

Goods requiring replacement or repair will be despatched once the original items have been returned and the fault has been determined or repaired as required.

11. Trademarks and Copyrights

We attempt to avoid all trademark and copyright infringement. Should you be the copyright owner and feel we have misused your copyright contact us and we will correct the situation immediately.

12. Payment Authorisations

12.1 By accepting these Terms and Conditions you agree that The Outdoorsman through a payment provider are authorised to charge your credit or debit card for the goods supplied. You also agree that we are authorised to charge your card with any other charges specified within these Terms and Conditions and within our Returns Policy.

12.2 In the event that any amounts become due (including missing or damaged returned goods, credit or debit card charge backs and dishonoured cheques) and remain unpaid for more than 14 days, we reserve the right to engage the services of a debt recovery agent. Charges incurred as a result of this action will be your responsibility.

13. Liability

13.1 The Outdoorsman will not be responsible for any loss incurred through the ordering, use or misuse of products supplied by us (including postal delays) or any other indirect or consequential loss.

14. Your Legal Rights as a Consumer

14.1 If any part of our Terms and Conditions is determined by a UK court to be invalid, illegal, void or otherwise unenforceable under any current or future law, the remainder of our Terms and Conditions shall not be affected thereby.

14.2 These Terms and Conditions do not affect any of your statutory rights.

14. Debts

14.1 In the event that goods are sent to clients and no payment is received, the client must make payment in full for the goods within one month of receipt.  Failure to do so will incur a levy on the outstanding amount equalling 2% per month of the amount outstanding for the entire period since the goods where dispatched.  This includes failed Paypal payments or Chargebacks on Credit Cards.  If no payment is received within 60 days of the goods being dispatched, a debt collection agency will be used to pursue the funds and the charges will be added to the amount owed.  Should the matter go to court, the client may incur further court costs in addition to this if it finds in the favour of The Outdoorsman.

14.2 If a client is unable to pay for the goods once dispatched and cannot do so within 30 days, we may accept them back as part payment subject to return conditions and a possible reduction in valuation of goods.  Any goods dispatched after the 30 day period will not be eligable to a full refund, but a percentage thereof that will be decided by The Outdoorsman based on the length of time the goods have been with the client and their perceived value to us.
